3. User Accounts and Registration
3.1 Teacher Accounts
To create exams, you must register for a teacher account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Be responsible for all activities under your account
- Notify us immediately of any unauthorized access
3.2 Student Access
Students do not need to create accounts. By taking an exam, students agree to:
- Provide their name and email address (if required by the teacher)
- Follow exam rules and academic integrity policies
- Allow proctoring monitoring if enabled by the teacher
- Accept that their responses will be graded by AI
4. Acceptable Use Policy
You agree NOT to:
- Use the Platform for any illegal or unauthorized purpose
- Create exams that contain illegal, offensive, or harmful content
- Attempt to circumvent exam proctoring or integrity features
- Share exam answers or help others cheat
- Reverse engineer, decompile, or hack the Platform
- Upload viruses, malware, or malicious code
- Collect or harvest personal information of other users
- Impersonate others or create fake accounts
- Interfere with the proper functioning of the Platform
- Use the Platform to spam or harass others
5. Teacher Responsibilities
As a teacher using the Platform, you are responsible for:
- Creating accurate and appropriate exam content
- Ensuring exam questions comply with applicable laws and institutional policies
- Obtaining necessary permissions to use third-party content in exams
- Informing students about proctoring features if enabled
- Obtaining appropriate consent when using the Platform with minors
- Reviewing AI-generated grades and providing final grading decisions
- Maintaining academic integrity and preventing cheating
- Protecting student privacy and confidentiality
6. Student Responsibilities
As a student taking exams on the Platform, you agree to:
- Complete exams honestly and independently unless collaboration is explicitly allowed
- Not use unauthorized materials or assistance during exams
- Not share exam content or answers with others
- Follow all exam rules and time limits
- Provide consent for camera access if proctoring is required
- Not attempt to circumvent proctoring or monitoring systems
- Accept that violations may be reported to the teacher or institution
7. Intellectual Property
7.1 Platform Ownership
AI-Exams and all associated technology, trademarks, logos, and content are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our Platform without permission.
7.2 Your Content
You retain ownership of exams, questions, and content you create. By using the Platform, you grant us a license to:
- Store and process your content to provide our services
- Use AI technology to grade and analyze exam responses
- Create backups and ensure data availability
This license ends when you delete your content or account.
7.3 AI-Generated Content
Questions and grading feedback generated by AI are provided as suggestions. You are responsible for reviewing and approving all AI-generated content before using it in exams.
8. AI Grading and Accuracy
Our AI grading system uses Google Gemini technology. You acknowledge that:
- AI grading is provided as an automated assistance tool
- AI may not be 100% accurate in all cases
- Teachers should review AI grades before finalizing scores
- Teachers have final authority over grading decisions
- We are not responsible for grading errors or disputes
- Students should contact their teacher if they believe a grade is incorrect
9. Proctoring and Monitoring
When proctoring is enabled for an exam:
- Students must consent to camera access and monitoring
- Face detection is processed locally using MediaPipe technology
- No video or audio is recorded or stored
- Only behavioral event logs are retained (e.g., tab switches, looking away)
- Students can review monitoring features before starting the exam
- Teachers can access proctoring logs but not camera feeds
- Refusal to consent may result in inability to take the exam
10. Payment and Subscriptions
If we offer paid features in the future:
- Payment terms will be clearly disclosed before purchase
- Subscriptions may renew automatically unless cancelled
- Refunds will be handled according to our refund policy
- We reserve the right to change pricing with notice
- Failure to pay may result in service suspension
11. Data and Privacy
Your use of the Platform is governed by our Privacy Policy. By using the Platform, you consent to:
- Collection and processing of personal data as described in our Privacy Policy
- Use of cookies and tracking technologies
- Processing of exam content by AI services
- Storage of data on our servers and third-party infrastructure
12. Disclaimers and Limitations
12.1 Service Availability

- Uninterrupted or error-free service
- Complete accuracy of AI grading or question generation
- Prevention of all cheating or academic dishonesty
- Compatibility with all devices or browsers
- Data backup or recovery in all circumstances
12.2 Limitation of Liability
To the maximum extent permitted by law, we are not liable for:
- Indirect, incidental, or consequential damages
- Loss of data, grades, or academic records
- Technical failures or service interruptions
- Grading errors or disputes
- Actions of teachers or students using the Platform
- Third-party services (AI providers, hosting, etc.)
Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.
13. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use or misuse of the Platform
- Violation of these Terms and Conditions
- Violation of any laws or third-party rights
- Content you create or submit
- Academic disputes or grading disagreements
14. Termination
We may suspend or terminate your account if you:
- Violate these Terms and Conditions
- Engage in fraudulent or illegal activity
- Abuse or misuse the Platform
- Fail to pay for services (if applicable)
You may delete your account at any time. Upon termination:
- Your access to the Platform will be revoked
- Your exams and data may be deleted
- Student submissions may be retained for record-keeping
- Certain terms will survive termination (e.g., indemnification, limitations of liability)
15. Third-Party Services
Our Platform integrates with third-party services including:
- Supabase: Database and authentication
- Google Gemini: AI grading and question generation
- MediaPipe: Face detection for proctoring
These services are subject to their own terms and privacy policies. We are not responsible for third-party services or their actions.
16. Changes to Terms
We may update these Terms and Conditions at any time. Changes will be effective:
- Immediately upon posting for minor updates
- After 30 days notice for material changes
Continued use of the Platform after changes constitutes acceptance. If you disagree with changes, you must stop using the Platform and delete your account.
17. Governing Law
